DN Dispute Resolution Process
Step
1
The complainant submits a request forrelief concerning a domain name dispute [Note 1].

Upon receipt of the complaint, the Dispute Resolution Service Provider will query TWNIC for the registration data of the disputed domain name and request the complainant to file a formal complaint. The complaint must follow the format and content prescribed by the Dispute Resolution Service Provider.

The Dispute Resolution Service Provider sends the complaint to the domain name registrant (hereinafter referred to as the "registrant") and TWNIC.

The Dispute Resolution Service Provider notifies the registrant, the complainant, and TWNIC that the dispute resolution procedure has commenced [Note 2] .

The registrant submits a response in accordance with the rules of the Domain Name Dispute Resolution Policy. The response must follow the format prescribed in the annexes of the Dispute Resolution Service Provider.

The Dispute Resolution Service Provider appoints panelist to form the Panel [Note 3].

The Dispute Resolution Service Provider notifies the registrant, the complainant, and TWNIC of the members of the Panelist and the scheduled date for the Decision of the Panel.

The Panel submits the Decision to the Dispute Resolution Service Provider.

The Dispute Resolution Service Provider informs the registrant, the complainant, and TWNIC of the Decision of the Panel and publishes it on website.
Step

TWNIC notifies the registrant and the complainant by e-mail or official letter to implement the Decision of the Panel. The Decision may be one of the following three outcomes:
Transfer
The complainant selects a new registrar and submits the registration information for the domain name, a company registration certificate, and the TWNIC notification letter.
Cancel
TWNIC and the original registrar cancel the disputed domain name and remove the registration data.
Rejection
The domain name status returns to normal.
Step

The newly selected registrar notifies TWNIC to process the transfer of the disputed domain name. TWNIC updates the domain status to “New registration and Pending Documentation Review.”

The registrar assists the complainant in entering the domain registration data into the database and provides the domain password to the complainant.

The complainant completes the payment of the domain name fee in accordance with the registrar’s rules, thereby finalizing the transfer. Under Article 14 of the Dispute Resolution Policy, no transfer may occur within 20 days.

According to Article 9 of the Domain Name Dispute Resolution Policy, the relief requested by the complainant is either “cancellation of the registrant’s domain name” or “transfer of the domain name to the complainant.”

Once the domain name enters the dispute resolution procedure, its status becomes “Under Domain Name Dispute Resolution.” During this period, the domain name cannot undergo any modification, but it continues to function normally in DNS resolution.

The composition of the Panel depends on the number of Panelist:
- If composed of one expert: the Dispute Resolution Service Provider appoints the panelist.
- If composed of three experts:
The complainant and registrant each select three candidates from the provider’s expert list. The provider selects one expert from each party’s candidate list. The third expert is chosen by the provider from a list of five experts, considering the parties’ input.As for how the number of experts in the panel is determined, please refer to the diagram below for explanation.

Experts must have substantial knowledge of intellectual property rights, e-commerce, and related fields to be appointed.
