TWNIC Internet Address Reclamation and Transfer Policy

- The reclamation and transfer of Internet addresses (including IPv4 and IPv6, hereinafter collectively referred to as 'IP addresses') managed by TWNIC shall be governed by this policy, except as otherwise provided in the 'Internet Address Registration Management Regulations'.
- If any IP address user (including Internet Service Providers (ISPs) and Internet End Users directly allocated by TWNIC) meets any of the following conditions, TWNIC may, with approval from the Internet Address and Protocol Committee, reclaim all allocated IP addresses and revoke the ISP’s authorization if applicable:
- (1) Ceases business operations, dissolves, or declares bankruptcy;
- (2) Violates the 'Internet Address Registration Management Regulations' or related TWNIC policies and fails to rectify after being notified within a specified period, in cases of serious infractions;
- (3) As an ISP, loses qualification to allocate IP addresses or transfers all address allocation and management operations to another entity;
- (4) As an ISP, ceases actual IP address allocation activities;
- (5) As an ISP, voluntarily applies for the return of all IP addresses due to no longer needing to allocate them.
- TWNIC may reclaim part of the allocated IP addresses under the following circumstances:
- (1) The address user’s actual IP address usage decreases, and they voluntarily apply for partial reclamation;
- (2) Violations of TWNIC policies without rectification after notification;
- (3) ISPs fail to meet the announced usage ratios during annual audits;
- (4) ISPs fail to allocate IP addresses truthfully according to TWNIC regulations.
- In the event of mergers, acquisitions, splits, or takeovers involving IP addresses, the involved address users or Regional Internet Registry (RIR) members must provide relevant documentation and apply to TWNIC for address transfer, subject to payment of transfer fees as stipulated in Article 9:
- (1) Transfers between address users are applied for by the receiving entity;
- (2) Transfers to RIR members are applied for by the transferring address user;
- (3) Fees already paid to TWNIC will not be refunded after transfer approval.
- If TWNIC determines that transferring IP addresses can reduce additional costs incurred by address changes, and the receiving address user’s plan complies with TWNIC regulations, TWNIC may approve the transfer without reclamation.
- Address users undergoing a name change must submit supporting documents to apply for the update, which will be reviewed and processed by TWNIC.
- IPv4 address transfer applications must comply with the following:
- (1) Only IPv4 addresses managed by TWNIC are eligible for transfer. ISPs may only transfer to other ISPs. The minimum transferable block is /24. Address blocks under 103/8 and those obtained from APNIC after July 2, 2019, cannot be transferred within five years of allocation.
- (2) When applying for the transfer of IPv4 addresses managed by TWNIC, the transferring entity shall be a registered address user of TWNIC. The application shall be submitted in writing, explicitly stating the intent to transfer the designated IPv4 address block to the receiving entity, which shall be either another address user of TWNIC or a member of a Regional Internet Registry (RIR). The application shall include a declaration certifying that the specified IPv4 address block is not currently in use and is free from any disputes regarding its usage. If the transferring address user has any outstanding payments related to IP address maintenance fees or allocation fees, such fees must be fully settled prior to the execution of the IPv4 address transfer.
- (3) When applying for the transfer of IPv4 addresses managed by TWNIC, the receiving entity must be either a registered address user of TWNIC or a member of a Regional Internet Registry (RIR). A written application shall be submitted to TWNIC, specifying the anticipated demand for IPv4 addresses over the next 24 months, the quantity of IP addresses intended to be received, and relevant supporting documentation. The application must be based on the projected needs for the upcoming 24-month period and shall include a detailed utilization plan, current usage rate of held IPv4 addresses, and documentation substantiating the stated demand.
- (4) When applying for the transfer of IPv4 addresses managed by TWNIC, the receiving entity must be either a member of a Regional Internet Registry (RIR) or a registered address user of TWNIC with the necessary qualifications. If the receiving entity is not an RIR member and has not yet obtained the status of a TWNIC address user, it must concurrently submit the required documentation to apply for address user registration with TWNIC.
- (5) In cases where an address user intends to receive IPv4 addresses from an RIR member that are not under the management of TWNIC, the address user shall be responsible for submitting an application to TWNIC. The application shall be made in writing and shall include a statement detailing the projected IPv4 address requirements for the next 24 months, the quantity of IPv4 addresses intended to be received, and supporting documentation.
- TWNIC may approve transfers if they promote efficient IPv4 address utilization and the submitted documentation from both parties complies with TWNIC regulations.
- Transfer Fees:
- (1) All IPv4 address transfers are subject to transfer fees. The first transfer to a new address user who does not hold TWNIC-managed IP addresses is exempt from transfer fees, paying only the holding fee.
- (2) Transfer fees are calculated at 20% of the annual fee for the transferred IPv4 addresses.
- (3) The party responsible for paying the transfer fee is as follows:
- I.For transfers between address users, the receiving address user shall pay the transfer fee.
- II.For transfers from an RIR member to an address user, the receiving address user shall pay the transfer fee.
- III.For transfers from an address user to an RIR member, the transferring address user shall pay the transfer fee.
- (4) For transfers involving RIR members and TWNIC address users, TWNIC will collect and remit related RIR fees.
- This policy is effective upon approval by the Internet Address and Protocol Committee. Amendments follow the same process.
